1. Introduction

Welcome to Contactivity Corp (“Contactivity”). This Acceptable Use Policy (AUP) is designed to ensure the lawful and responsible use of Contactivity’s telecommunications services while maintaining compliance with relevant telecommunications laws and regulations. This AUP outlines the terms and conditions governing the use of our telecommunications network and services. By using Contactivity’s services, you agree to abide by this AUP.

2. Amendments to the AUP

Contactivity may update this AUP from time to time to align with changes in telecommunications laws and regulations. Customers are responsible for regularly reviewing the AUP on Contactivity’s website (https://www.contactivity.io/aup.pdf) for any updates. Continued use of Contactivity’s services after changes have been posted constitutes acceptance of the revised AUP.

3. Responsible Use of Telecommunications

Contactivity values the importance of responsible telecommunications use. The internet is a shared resource, and customers are expected to exercise good judgment in their telecommunications activities. Contactivity cannot monitor or vouch for the accuracy, quality, or legality of information obtained through the internet.

4. User-Created Content

Customers are solely responsible for the telecommunications content (call, text, mms) they create or disseminate. Contactivity does not review, edit, censor, or endorse any user-generated content. Customers must comply with telecommunications laws, including copyright and defamation laws, when creating or sharing content.

5. Prohibited Telecommunications Activities

Contactivity defines “telecommunications abuse” as activities that are strictly prohibited under this AUP, ensuring compliance with telecommunications laws and regulations. While not exhaustive, the following are examples of prohibited telecommunications activities:

• Violating applicable telecommunications laws, regulations, treaties, or tariffs.
• Violating acceptable use policies of telecommunications networks, machines, or services accessed through Contactivity’s network.
• Infringing on intellectual property rights, including those of Contactivity or third parties.
• Violating the privacy rights of telecommunications users.
• Engaging in deceptive telecommunications practices, including misleading marketing.

Additional prohibited telecommunications activities include, but are not limited to:

• Attempting to interfere with or deny service to any telecommunications user or host.
• Falsifying telecommunications header information, user identification, or user information.
• Introducing malicious programs into the telecommunications network.
• Unauthorized monitoring or scanning of telecommunications networks.
• Unauthorized security breaches or disruptions of telecommunications services.
• Unauthorized access to telecommunications data, machines, or networks.
• Using any program, script, command, or messaging to interfere with others’ telecommunications sessions.
• Sending unsolicited commercial or bulk telecommunications messages (spam).
• Hosting telecommunications services that promote unsolicited communications.
• Providing tools or support services for unsolicited telecommunications.
• Maintaining open relay telecommunications servers.
• Collecting telecommunications information for unsolicited telecommunications purposes.
• Transmitting or receiving copyrighted material without proper authorization.
• Transmitting or receiving offensive or illegal telecommunications content.
• Violating export control laws related to telecommunications.
• Any other telecommunications activity that may harm Contactivity, its customers, or its partners.

Additional Prohibited Activities:

• Use our network to originate unlawful or illegal calls.
• Use our network to originate robocalls. • Use our network to send robotext messages.
• Use our DIDs to originate unlawful or illegal calls.
• Use our DIDs to originate robocalls.
• Use our DIDs to send robotext messages.
• Resale our DIDs to a third party without approval.
• Resale our services to a third party without approval.

These activities are strictly prohibited and may result in immediate action, including but not limited to suspension or termination of services, as well as legal action in accordance with applicable laws and regulations.

6. Enforcement of Telecommunications Laws

Contactivity reserves the right to enforce this AUP to ensure compliance with telecommunications laws and regulations, taking appropriate actions such as filtering, service denial, suspension, or termination of service access when violations occur. Contactivity may also cooperate with law enforcement and regulatory authorities in response to telecommunications violations.

7. Reporting Violations

Users who believe a violation of this AUP has occurred are encouraged to report it to Contactivity at compliance@contactivity.io.

8. Privacy of Telecommunications

Contactivity is committed to protecting the privacy of telecommunications communications. Contactivity will comply fully with all applicable laws concerning the privacy of its customers’ telecommunications communications. This includes not intentionally monitoring or disclosing private electronic telecommunications messages, call logs, MMS, except as required by law.

9. Digital Millennium Copyright Act (DMCA) Policy

Contactivity responds to claims of intellectual property infringement in accordance with the DMCA and other applicable intellectual property laws. Notices of claimed infringement should be directed to Contactivity at compliance@contactivity.io.
